Terms and Conditions for the Supply of Goods through this website. This service is operated by Elements By Nature Limited (company number 11306080), trading as Elements By Nature (“we”, “us” or “our”).
1. The Contract between you and us
We must receive payment in full for the price of the goods you order before your order can be accepted. Once payment has been received we will confirm that your order has been accepted by sending an e-mail to the address you provide in your order. Our acceptance of your order brings into existence a legally binding contract between us. Only adults (persons aged 18 and over) are entitled to enter into legally binding contracts and are therefore the only people entitled to transact through this site.
2. Pricing and Delivery
2.1 The prices payable for goods you order are as set out on our website at the time of your order.
2.1.1 All of our prices are in UK Pounds Sterling. If you purchase from outside the UK, currency fluctuations and your card provider’s charges may affect the amount billed to your card.

3. Your right to cancel and return goods
3.1 You have a statutory right to cancel your order for any reason within 14 days of receiving your goods, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. You do not need to give a reason.
3.2 To cancel or return an order, contact us by e-mail at elementsbynature@gmail.com, or speak to us in any of our shops, within 3 business days of receiving your order so we can guide you through the process. Full detail on how returns and exchanges work is set out on our Delivery & Returns page.
3.3 Returned items should not be worn or damaged, and any security tag should remain attached. You are welcome to bring items back to any of our three shops in person instead of posting them.
4. Cancellation by us
4.1 We reserve the right to cancel the contract between you and us if: (a) we have insufficient stock to deliver the goods you have ordered; (b) we do not deliver to your area; or (c) one or more of the items you ordered was listed at an incorrect price due to a typographical error.
4.2 If we cancel your contract we will notify you by e-mail and refund any sum already taken as soon as possible, and in any event within 14 days.
5. Delivery of goods to you
5.1 We will deliver the goods you order to the address you give us at the time of your order. It is your responsibility to make sure that address is correct and that someone is able to take delivery.
5.2 Delivery charges and estimated timescales, including for international orders, are shown at checkout. Any duties or taxes due in the destination country are the recipient’s responsibility.
5.3 You will own the goods you have ordered once they have been dispatched to you. Once delivered, goods are held at your own risk and we are not liable for their loss or destruction.
5.4 We make no promise that the website is appropriate for use outside the United Kingdom. If you access this site from outside the UK, you are responsible for compliance with local laws.
6. Liability
6.1 If the goods we deliver are not what you ordered, or are damaged, defective, or the wrong quantity, please notify us by e-mail within 3 working days of delivery.
6.2 If you do not receive goods you have ordered within a reasonable time, please notify us so we can put things right, by making good the shortage, replacing the goods, or refunding the amount paid.
6.3 Save as required by law, we will not be liable for indirect or consequential loss or expense arising from any problem notified under this clause, beyond the remedies set out above.
6.4 You must comply with all applicable regulations and legislation, including any customs or import requirements, when purchasing goods for delivery outside the UK.
6.5 Nothing in these terms limits any right you have as a consumer under applicable law, or excludes our liability for death or personal injury caused by our negligence.
7. Notices
Unless stated otherwise, all notices from you to us must be sent by e-mail to elementsbynature@gmail.com. Notices from us to you will be displayed on our website from time to time.
8. Invalidity
If any part of these terms is found unenforceable, the rest of these terms remain in effect.
9. Privacy
You acknowledge and agree to be bound by our Privacy Policy.
10. Third Party Rights
A person who is not a party to this agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement.
11. Governing Law
These terms are governed by and interpreted in accordance with English law, and the English courts have exclusive jurisdiction over any related dispute.
12. Entire Agreement
12.1 These terms, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of goods to you.
12.2 We make no representation or warranty about the accuracy or completeness of the information published on our website. From time to time our site may contain technical inaccuracies or typographical errors.
13. Trade Marks
Elements By Nature Limited (company number 11306080) is the operator of www.elementsbynature.co.uk. All trademarks, product names and company names or logos referred to on this site are the property of their respective owners.
14. Events Beyond Our Control
We will not be liable for any delay or failure to perform this agreement caused by circumstances beyond our reasonable control, including strikes, industrial disputes, system or network failure, flood, fire, explosion or accident.
